Privacy statement

We, Frencken America, Inc. dba US Motion, respect your privacy. This privacy statement informs you about the personal data we process, the processing activities we conduct and your rights as a data subject.

Processing of personal data

Personal data means any information relating to an identified or identifiable natural person (the “data subject”), such as a name, email address, identification number and/or phone number. We process the following personal data:

  • about you, as (contact person of) our customers and suppliers: name, email address, phone number
  • about you as an applicant: name, email address, phone number and the personal data you additionally provide to use by sending your curriculum vitae.

The processing activities that we conduct with such personal data have several purposes: performance of a contract, communication with our customers and suppliers regarding orders (to be placed), and the process of finding new employees for outstanding vacancies. Additionally, we might process personal data to detect and/or prevent fraud.

All processing activities are based on a legal ground. Processing might be based on your (implicit) consent to the processing of your data for one or more specific purposes, mostly within the HR department. Processing might also be necessary for the performance of a contract, necessary for compliance with one of our legal obligations, or necessary in light of our legitimate (business) interest to stay in contact with our customers and suppliers – which we will always balance with your right to privacy.

We will not transfer personal data to third parties, unless such transfer is necessary and legitimate in light of one of the purposes described above. We store personal data for as long as necessary based on the purpose of processing. We may store personal data longer than necessary in light of the purpose of processing for archiving purposes.

Children’s personal data

We do not knowingly collect or solicit personal data from children under the age of 13 through our website. If we notice that we have collected personal data from a child under the age of 13, we will delete such data.

Your rights

You, as a data subject, have the right to obtain confirmation from us as to whether or not personal about you are being processed, and if so, access to the personal data. Additionally, you have the right to ask for rectification and/or erasure of personal data concerning you. You also have the right to ask us for restruction of processing, the right to object against specific processing activities and the right to data portability.

If and in so far as we (partly) base the processing of personal data concerning you based on your consent, you have the right to withdraw your consent at all times. Withdrawal of your consent does not affect the lawfulness of processing based on your consent before withdrawal.

You have the right to lodge a complaint with a supervisory authority, in case you find that your rights regarding the processing of personal data are being violated by us.

California residents

Further to the above, California residents may specifically ask us to provide them with a list of certain categories of personal information we have disclosed to third parties for their direct marketing purposes during the preceding calendar year, and the identities of such third parties. At this time, we currently do not share any personal data with third parties for their direct marketing purposes.
